Personal data processing rules and data protection policy
1. KEY DEFINITIONS
1.1 Company - UAB BIURO ABC - Lithuania (company code: 305458442; registered office address: Savanorių str. 193, LT-02300 Vilnius, Lithuania; website: https://upupdesk.com)
1.2. Data subject - any person: a customer of the company, an employee, a partner, a visitor whose personal data is processed by the company.
1.3. Employee - means a person who has entered into an employment or similar contract with the Company and is appointed to process Personal Data by the decision of the Head of the Company or whose personal data is processed.
1.4. Customer - any person who orders, buys, or uses the services of our company. The customer with whom the company has entered into a purchase transaction must ensure that all end-users (such as family members) who use the company's services ordered by the customer are aware of and comply with the privacy notice.
1.5. "The third party" means a legal or natural person, other than a data subject, a controller, a processor, and persons directly authorized by the controller or a processor to process data.
1.6. "Personal data" shall mean any information relating to a natural person which is known or can be identified, directly or indirectly, by means of data such as name, date of birth, one or more personal, physical, or psychological characteristics of the person. , economic, cultural, or social characteristics.

1.10. 1.14. Other terms used in these Rules for the Processing and Use of Personal Data (hereinafter - the Rules) correspond to the terms established in the Law on the Legal Protection of Personal Data of the Republic of Lithuania (hereinafter - the Law) and/or in 2016. April 27 Regulation of the European Parliament and of the Council 2016/679 (hereinafter referred to as the Regulation).
2. GENERAL PROVISIONS
2.1. These Rules regulate the actions of the Company and its employees in processing the personal data of Data Subjects and Employees using automatic and non-automatic personal data processing facilities installed in the Company, as well as establish the rights of the Data Subject and the Employee, personal data protection enforcement measures and other issues.

2.3. All data is collected, stored and processed by the Company in accordance with the European Union General Data Protection Regulation no. 2016/679, other legal provisions. 3. OBJECTIVES AND METHODS OF DATA PROCESSING
3.1. The Company offers a wide selection of goods and services (hereinafter - Services). The information that the Company collects about Data Subjects depends on what information the Data Subject provides to us when ordering Services or registering on our websites or ordering Services without registration.
3.2. The Company shall process only the data of the Data Subject:
3.2.1. Which it receives from the Data Subject when it communicates or has a legal relationship with the Company, such as purchasing the Services or registering for the Services, subscribing to newsletters or contacting us for information;

3.4. Personal data shall be processed and used according to the purposes for which the Data Subject provided them to the Company or for other purposes approved by the Data Subject or the Employee.
3.5. The company may collect data belonging to the following categories:

3.5.2. data relating to the provision of goods and / or services, invoicing, details of payments, information on consent and non-consent to the processing of personal data for direct marketing purposes and provision to third parties, contact details and related records;

3.5.4. other data about the use of services and / or goods, such as data collected using cookies and similar technologies related to Internet browsing, etc .;

3.5.6. records of telephone conversations when Customers call the Company's customer service managers or answer calls of the Company's employees;
3.5.7. other data that is collected with your consent and that is defined in detail at the time your consent is requested.
3.6. Unless otherwise provided in the agreement between the Data Controller and the Company on the provision of services and related processing of personal data of the Data Subject, the Company shall be deemed to process the personal data of the Data Subject only for the following purposes:
3.6.1. Customer identification by logging in to your account on the Company's Website;
3.6.2. Concluding and executing electronic contracts; Accounting of customers and settlements under concluded agreements; Protection of the creditor's interests and prevention of material losses; Debt collection for customers. 3.6.5. 3.8. By concluding an employment contract with the Company, the Employee confirms and voluntarily agrees that the Company shall manage and process the following personal data of the Employee for the purposes specified in these Rules:
3.8.1. For the purposes of concluding, executing and accounting employment contracts, the names of employees, personal identification codes, dates of birth, addresses of residence, educational documents, documents certifying the qualifications of employees, numbers of bank accounts to which wages and other benefits are paid, personal medical records , certificates of working capacity, pregnancy.
3.8.2. For the purpose of proper performance of the company's duties as an employer established by legal acts, the names and surnames of employees, personal identification codes, information on the marital status and health condition of employees would be processed.
3.8.3. For the purpose of proper communication with employees outside working hours, the addresses of the employees' place of residence, personal telephone numbers and personal e-mail addresses would be processed with the consent of the employees.
3.8.4. In order to ensure the safety of employees and their property and to ensure decent working conditions, the employer would monitor the office premises and process information related to the employee's state of health, which directly affects the employee's work functions and ability to perform them in accordance with legal acts.
3.9. The company shall ensure that personal data are processed accurately, fairly and lawfully, for purposes other than those laid down before the collection of personal data, and that they are processed only in strict compliance with the lawful and transparent processing of personal data. requirements.
3.10. The Company's employees are informed that all data of the Data Subjects and Employees managed and received and processed by the Company are completely confidential (except for the Employees processing their own personal data) and must be processed in accordance with the confidentiality conditions set forth in these rules.

4.2. In performing their duties and processing personal data provided by the Data Subject, the employees of the Company shall observe the following principles:

4.2.3 The personal data of the data subject may be processed only by the employees of the Company with appropriate competence (administrators of IT systems, websites or databases, managers of the Company, managers and accounting staff).
4.2.4. The Company does not disclose personal data to any third parties, except in the cases provided for by legal acts or if the Company is obliged to do so by the Data Subject.
4.3. Every employee of the Company who processes personal data must:

4.3.5. in order to prevent the accidental or unlawful destruction, alteration, disclosure of personal data, as well as any other unlawful processing, shall keep documents and data files properly and securely and shall avoid making unnecessary copies. Copies of company documents containing personal data must be destroyed in such a way that their contents cannot be reproduced and identified.
4.3.6. immediately notify the head of the Company or the responsible person appointed by him of any suspicious situation that may pose a threat to the security of personal data and take measures to prevent such a situation.
5. MARKETING AND CORRESPONDENCE
5.1. The Company shall ensure that the personal data of the Data Subjects for direct marketing purposes are processed only on a lawful basis and undertakes not to take any direct marketing action against those Data Subjects who have objected to the processing of personal data or otherwise informed the Data Controller that they do not wish to: The data subject's data would be processed for direct marketing purposes.

7. SECURITY AND PROCESSING OF PERSONAL DATA IN THE COMPANY
7.1. Personal data processed in the Company shall be stored in computer media, electronic form, paper form. 7.6. The computer maintenance officer must ensure that personal data files are not "shared" from other computers whose users are not authorized to process personal data and that antivirus programs are updated periodically.
7.7. The computer maintenance officer shall make copies of the data files on the computers. If these files are lost or damaged, the responsible employee must restore them within a few working days.
7.8. An employee loses the right to process personal data when the employee's employment or similar contract with the Company expires, or when the head of the Company revokes the employee's appointment to process personal data.
7.9. Documents related to the Company's employees and their copies, financing, accounting and reporting, archival or other files containing personal data are stored in lockers / drawers / cabinets / archives. Documents containing personal data must not be kept in a visible place accessible to all.
7.10. In order to ensure the protection of personal data, the Company implements or plans to implement the following personal data protection measures:
7.10.1. administrative (establishment of secure processing of employees' documents and computer data and databases, as well as organization of work in various fields of activity, acquaintance of personnel with personal data protection, etc.)
7.10.2. hardware and software protection (administration of servers, information systems and databases, maintenance of workplaces, Company's premises, protection of operating systems, protection against computer viruses, etc.);
7.10.3. protection of communications and computer networks (filtering of shared data, programs, unwanted data packets (firewall), etc.).
7.11. The technical and software measures for the protection of personal data must ensure:
7.11.1. installation of a repository for copies of operating systems and databases;
7.11.2. contingency strategy for contingency systems (contingency management);
7.11.3. authorized use of the data, their integrity.
7.12. Upon identification of a possible violation of personal data processing, a commission shall be formed by at least 3 (three) employees of the Company and the company maintaining the IT infrastructure of the Company to investigate the circumstances of the incident.
7.13. If the fact of a personal data security breach is established, the Company shall notify the State Data Protection Inspectorate thereof in accordance with the recommendations approved by it, available at the following address:
7.14. In case the personal data of the Data Subjects are provided to data processors (subcontractors), such as debt collection companies, lawyers, IT infrastructure, website administration companies, data processors used by the Company or third parties used by the Company must guarantee the necessary technical and organizational measures for the protection of personal data and ensure that such measures are complied with.
7.15. The Company may also provide personal data of Data Subjects in response to requests from a court or state authority, only to the extent necessary for the proper execution of applicable law or a court order/certificate.
7.16. The Company shall take into account all specific obligations under applicable data protection legislation, taking into account the nature of the data processing and the information available. Specific obligations include security of data processing (Article 32 of the Regulation), notification of personal data breaches (Articles 33-34 of the Regulation) and data protection impact assessment and prior consultation (Articles 35-36 of the Regulation).
7.17. The personal data of a data subject shall be processed no longer than required by the purposes of data processing or provided by legal acts if a longer retention of data is established therein.
7.18. Data collected for direct marketing purposes will be kept until you withdraw your consent, but in any case for no longer than 2 years from the date of your consent.
7.19. In all cases, data may be processed only until a separate notice from the Data Subject requesting the interruption or suspension of the processing of the data concerned, unless the law provides for time limits that provide a basis for longer retention of personal data.
7.20. At the end of the above-mentioned processing period, personal data shall be deleted, together with all available copies of such data.
8. RIGHTS OF THE DATA SUBJECT
8.1. The data subject shall have the following fundamental rights:
8.1.1. be aware of the processing of your personal data;
8.1.2. to get acquainted with what his personal data are processed and for what purpose and to whom they are provided;
8.1.3. to demand correction, correction or supplementation of incorrect or incomplete personal data of the Data Subject, destruction of the personal data of the Data Subject or suspension of the processing of personal data of the Data Subject, except storage, when the data is processed without complying with these rules and other legal acts;
8.1.4. not consent to the processing of personal data of the Data Subject;
8.1.5. to require that the personal data of the Data Subject be provided to him / her in a freely accessible electronic form so that he / she may transfer these data to another data processor (right to data portability);
8.1.6. request the destruction of your personal data ("right to be forgotten") in the following cases:
8.1.6.1 personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
8.1.6.2 The data subject withdraws consent (if the legal basis for the processing of his or her personal data was consent);
8.1.6.3 it is established that the personal data of the Data Subject have been processed unlawfully;

9. RESPONSIBILITY
9.1. The data subject must provide the Company with complete and correct personal data and take all necessary actions and measures to update changes in his or her personal data in a timely manner. 10. VALIDITY AND AMENDMENT OF THE RULES

11. FINAL PROVISIONS
11.1. The law of the Republic of Lithuania shall apply to these Rules and to the legal relations arising on the basis of these Rules.
11.1. Any dispute arising out of the application of these Rules shall be settled by negotiation. In case of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the legal acts of the Republic of Lithuania.
